TRADEMARKS
In order to seek complete protection under trademark, it is important that one is aware of the concept of the classes under which classification is done. There are 45 classes in all, divided into two broad categories, one each for goods and services, with classes 1 through 34 for various kinds of goods, and classes 35 through 45 for various kinds of services.
The registration is classified on the basis of the business's involvement in particular categories of goods and/or services. Registering the IP asset under a specific class ensures that no other organization can use the same shape, style, design, colour, etc. in that particular class. For instance, a bank uses a particular shade of red or blue in its logo. If the logo is protected under trademark under Class 36 with the colour claim (“Insurance, financial affairs; monetary affairs; real estate affairs”), the same blue shade cannot be used by any other organization in the same class, unless it is a case of co-existence.
